These terms of use (EULA) govern the use of the Eatsboard iOS app, website and associated services, including Premium subscriptions, credits and AI features.

These terms apply to the Eatsboard iOS app, the website at https://www.eatsboard.com and the associated backend services. By installing or using the app, you agree to these terms. Any differing terms of the user do not apply.

The contract for use of the app is between you and the provider named above, not Apple Inc. (“Apple”).

2. Licence and service description

The provider grants you a personal, non-exclusive and non-transferable licence to install and use the Eatsboard app on Apple devices that you own or control. Use is permitted only in accordance with the applicable Apple Media Services Usage Rules. Where those rules permit Family Sharing or volume purchasing, the app may also be used by the persons authorised under those arrangements.

Eatsboard is a meal planning application. Its features include weekly plans, dish and recipe management, shopping lists, group features and AI-assisted suggestions and assistance.

The range of features may evolve. Individual features may be added, changed or discontinued where this is reasonable for you and contractually promised core services remain available.

Eatsboard does not replace medical or nutritional advice. The app provides organisational suggestions, but does not make medical diagnoses or give binding health instructions. You are responsible for checking ingredient and allergen information.

3. Account and registration

An account is required to use the app. You can sign in with email and password, Google or Sign in with Apple. You must keep your credentials confidential and inform us of any unauthorised use of your account.

You must be at least 16 years old to create an account. Eatsboard is not specifically directed at children.

You can delete your account at any time directly in the app under Profile → Delete account. Details of data deletion are set out in the privacy policy.

4. Premium subscriptions

Certain features are available through a paid Premium subscription. The included features and usage allowances are displayed in the app before purchase.

The term, price, included services and any trial period offered are displayed in the app and App Store immediately before purchase. The information in the purchase dialogue in your local currency is authoritative.

Automatic renewal

Subscriptions automatically renew for the respective term at the then-current price unless cancelled at least 24 hours before the current period ends. Payment is processed through your Apple account and charged within 24 hours before the new period begins.

You can cancel at any time in your Apple account settings (Settings → Apple ID → Subscriptions or App Store → Manage subscription). Deleting the app does not cancel a subscription. After cancellation, Premium remains active until the end of the period already paid for.

Purchases, refunds and withdrawals are handled through Apple. Send refund requests to Apple (for example, via reportaproblem.apple.com). When purchasing, you agree that the service begins immediately; to the extent permitted by law, this extinguishes your right of withdrawal for the current period.

Subscriptions and credits remain permanently with the Eatsboard account used to purchase them. “Restore purchases” restores the status of that original account and does not transfer purchases to another account. This also applies after a subscription expires. If an account conflict occurs, sign in with the original account or contact Support.

After complete deletion of the original account, subscriptions and credits cannot be restored or transferred to a new account. Deleting your account does not cancel your Apple subscription; manage it in your Apple subscriptions before deletion. Direct questions about charges or refunds to Apple.

5. Credits

In addition to subscriptions, credit packages may be offered as one-time purchases. The quantity, price and AI actions charged are displayed in the app before purchase. The information in the App Store purchase dialogue is authoritative.

Credits do not expire, are tied to your Eatsboard account, cannot be transferred to other accounts and cannot be redeemed for cash. If Apple refunds a credit purchase, the corresponding credits are deducted again; credits already used are taken into account only down to a balance of zero.

6. AI features and usage limits

AI features are subject to usage limits (monthly allowances or credits). The app shows your remaining allowance. To prevent abuse, we may limit requests that are clearly automated or constitute an abuse of rights.

AI-generated content is created automatically and may contain errors. It consists of suggestions, not guaranteed characteristics. In particular, check information about ingredients, quantities, allergens and preparation before using it.

7. User content

You can add your own content to the app, such as dishes, recipes, photos, notes and group data. You warrant that you hold the necessary rights and do not upload unlawful content.

You grant us the non-exclusive rights to use your content that are technically necessary to provide the app (storage, processing and display, including to group members with whom you share content). No further rights are transferred.

We may remove or block content that violates these terms or applicable law.

8. Availability

We strive to provide highly available services but do not owe uninterrupted availability. Maintenance, further development, disruptions at third-party providers (such as AI providers, Apple or hosting providers) or force majeure may cause temporary restrictions.

9. Liability

We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, and under the German Product Liability Act.

In cases of ordinary negligence, we are liable only for breach of essential contractual obligations (obligations whose fulfilment makes proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely), limited to foreseeable damage typical of the contract. All other liability is excluded.

10. Term and termination

The usage contract runs for an indefinite period. You can terminate it at any time by deleting your account; you must also cancel ongoing subscriptions through your Apple account (see section 4).

We may terminate the contract with reasonable notice or suspend your account if you materially or repeatedly violate these terms. Services already paid for remain unaffected or are refunded proportionately where required by law.

11. Apple-specific terms

These terms are solely between you and the provider, not Apple. The provider alone is responsible for the app and its content. To the extent that maintenance or support services are owed under applicable law, they are provided solely by the provider; Apple has no obligation to provide them.

The provider is responsible for statutory warranty claims. If the app fails to conform to an applicable warranty, you may notify Apple; Apple may then refund any purchase price you paid for the app. To the extent permitted by law, there are no further warranty claims against Apple.

The provider, not Apple, is responsible for claims relating to the app, its possession or its use. These include, in particular, product liability claims, claims concerning failure to comply with legal or regulatory requirements, and claims under consumer and data protection law.

If a third party claims that the app or its use infringes intellectual property rights, the provider, not Apple, is responsible to the extent required by law for investigating, defending, settling and resolving that claim.

You represent that you are not located in a country subject to a US government embargo and are not listed on any list of prohibited or restricted parties. When using the app, you comply with applicable third-party agreements, in particular the terms of your mobile network or internet provider and the Apple App Store terms of use.

Apple and its subsidiaries are third-party beneficiaries of these terms. Upon your acceptance, Apple and its subsidiaries are entitled to enforce these Apple-specific terms against you.

12. Changes to these terms

We may update these terms when the app, legal requirements or services used change. We will inform you of material changes in the app or by email with reasonable advance notice. The current version is available at https://www.eatsboard.com/en/terms.

13. Final provisions

The laws of the Federal Republic of Germany apply. For consumers, this choice of law applies only to the extent that it does not deprive you of mandatory consumer protection provisions of your country of habitual residence.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

If any individual provision of these terms is invalid, the validity of the remaining provisions is unaffected.
